Terms & Conditions of Sale

Preamble

These Terms & Conditions of Sale (“Agreement”) govern all orders placed on the www.newearth.durban website (“Website”) between:

  • Teamplay Trading Enterprises CC (“New Earth”, “We”, “Us”, or “Our”), a South African CC company, with registered address at Unit 31, 1 Randworth Park, Randworth Place, Redhill, Durban, 4051, VAT #4520225634

  • The Customer (“You”, “Your”), being a natural person purchasing goods or services from the Website for personal use only (not for resale, commercial, charitable, or trade purposes)

Collectively, the Vendor and the Customer are referred to as the “Parties.”

By placing an order, the Customer agrees to be bound by these Terms & Conditions. This Agreement, together with the Website’s Terms of Use, forms a single, legally binding contract governing the purchase and delivery of goods and services.


1. Purpose, Applicable Law, and Territories

1.1 Purpose
This Agreement sets out the terms for ordering, paying for, tracking, and receiving goods or services from New Earth. It also covers warranties and the Customer’s right to change their mind after purchase, in accordance with applicable law.

New Earth may update these Terms at any time. The version online at the time of your order is the version that governs your purchase.

1.2 Territories
Orders may only be placed and delivered to South African addresses. Customers residing outside South Africa may not place orders on the Website.


2. Orders

2.1 Customer Acceptance
You must read and accept these Terms before placing an order. A summary of your order and this Agreement may be saved or printed for your records.

2.2 Vendor Acceptance
Orders are confirmed when New Earth sends an order acknowledgement email detailing:

  • Items ordered and pricing

  • VAT and applicable taxes

  • Delivery terms

If any items are unavailable, we will notify you and refund the unavailable items. Full order cancellations will also be refunded. No compensation applies for unavailability.


3. Goods and Pricing

3.1 Description of Goods
Product images and descriptions are indicative and for reference purposes only. They do not constitute a binding contract beyond the order confirmation.

3.2 Pricing
All prices are in South African Rands (R) and include VAT, excluding shipping. Prices may change at any time, but the confirmed order price will always apply. Shipping costs are displayed at checkout.

3.3 Discounts
Discounts and promotional offers are valid only during the stated promotion period and cannot be exchanged for cash. Discounts are personal and non-transferable. Only one discount may be applied per order; if multiple discounts are entered, the highest-value discount will apply.


4. Payment

4.1 Currency
Orders are paid in South African Rands.

4.2 Payment Methods
We accept Visa and Mastercard. Payment authorization is required at checkout. Orders may be verified with your bank. If payment is declined, your order will be cancelled.

4.3 Security
All payment data is encrypted using SSL. Payment is only debited once items are dispatched.

4.4 Fraud Prevention
For security, we may request additional verification of your order or payment details, including proof of identity or address.


5. Delivery

5.1 Delivery Terms
Orders are delivered within a maximum of 7 working days (subject to the chosen delivery option and destination). Orders placed on weekends or public holidays are processed the following business day.

Delivery is carried out via Courierit (Pty) Ltd, with tracking numbers provided for each order. Packages will be delivered to the address provided, including any required access codes or instructions.

5.2 Failed Deliveries
If a delivery attempt fails (e.g., absence, incorrect address), a non-delivery code will be sent to New Earth, and instructions will be left for the Customer to arrange delivery.


6. Warranties and Returns

Goods purchased may be returned or refunded subject to applicable warranties, except for personalized items.

6.1 Returns Procedure
To return goods, contact us at daryls@teamplaytrading.co.za to receive a Returns Authorization Number. Items must be:

  • Purchased on the Website

  • Delivered to the Customer

  • Returned in original condition and packaging, with the Returns Note attached

6.2 Shipping Returns
Customers are responsible for return shipping. If the Vendor is at fault (e.g., incorrect item), return costs will be reimbursed at the standard postal rate.

6.3 Processing Returns
Returned items will be inspected. Items that do not qualify for exchange or refund will be made available for collection or returned to the Customer at their expense.


7. Liability

New Earth is not liable for delays or failures caused by:

  • Force majeure (events beyond reasonable control)

  • Internet or network disruptions, viruses, or data loss


8. Electronic Signatures and Proof

Your online order confirmation and disclosure of payment details constitute binding electronic agreement and authorization to pay. All electronic records of orders, communications, and payments are legally admissible and enforceable.

In case of suspected fraudulent use of a payment method, the Customer must notify New Earth immediately.
